Understanding Occupational Injury Benefits in Taiwan 02: What Can You Claim?

It’s important to note that benefits for occupational injuries are different from those for ordinary illnesses or injuries.
Since the enactment of the Labor Occupational Accident Insurance and Protection Act on April 30, 2021 (hereafter referred to as the Act), the legal basis for occupational injury insurance has been completely separated from general labor insurance.
Therefore, if your case is not recognized as an occupational injury by the Bureau of Labor Insurance, or if you are not a worker covered under this Act, the benefits explained in this article will not apply to you.

Types of Benefits Available
Workers who suffer from occupational injuries may apply for five types of benefits:
Medical Benefits
Injury and Sickness Benefits
Disability Benefits
Death Benefits
Missing Person Benefits
1. Medical Benefits
These cover medical expenses incurred due to an occupational injury.However, it is important to note that only necessary medical treatments are covered.
2. Injury and Sickness Benefits
If an occupational injury prevents a worker from working, they may apply for injury and sickness benefits.
Here, “unable to work” specifically means being completely unable to work for the entire day.
3. Disability Benefits
If, after treatment, the condition becomes stable but results in permanent disability that meets the eligibility criteria, the worker may apply for disability benefits.
4. Death Benefits
If a worker dies due to an occupational injury during the period of valid occupational accident insurance,
the person who pays for the funeral expenses may apply for a funeral subsidy.
(Note: Family members of workers who are not covered under the Act or who were not enrolled in occupational accident insurance are not eligible to apply.)
5. Missing Person Benefits
If a worker goes missing due to an accident occurring during work, benefits will be issued starting from the date of disappearance.
This is a new category introduced under the Act, and its concept is relatively straightforward.
